- Substitutions, delays, or unavailability of products
Any liability related to loyalty points or gift cards is strictly limited to the value of points or the remaining balance on the relevant gift card.

You are responsible for any taxes resulting from your use of our Services, including loyalty points or gift cards. Consult a tax advisor for specific guidance.
4. CONFLICTS AND GOVERNING LAW
These Terms supersede any prior agreements or policies. If any provision conflicts with applicable law, that provision is severed and the remainder remains in effect.
These Terms and your use of our Services are governed by the laws of the State of California, excluding its conflicts of law rules.
5. MISCELLANEOUS LIABILITY AND COOKIES
We are not liable for delays or failures due to acts of nature or causes beyond our reasonable control.
Our websites and applications use cookies to improve user experience, track promotions, and analyze traffic. You may manage cookies via your browser settings. Any collected data will be aggregated and anonymized.

7. GIFT CARDS
Gift cards are prepaid, non-refundable, not redeemable for cash (except where required by law), and valid until redeemed. Gift cards can only be used at Gooseberry Goods locations.
Lost, stolen, or damaged gift cards will not be replaced. Misuse may result in cancellation of the card. Cash back for low balances is provided only as required by state law. Total liability does not exceed the gift card balance or $50 unless required by law.
8. SUBSTITUTIONS AND PRODUCT AVAILABILITY
We strive to maintain inventory, but substitutions may occur. You agree that we may charge the higher price if a substituted product costs more.
9. FOOD ALLERGENS AND INTOLERANCES
Gooseberry Goods INC identifies ingredients with allergens and trains staff on food allergy risks. However, cross-contamination may occur.
Allergic reactions may be severe or life-threatening. Food intolerances (e.g., lactose, MSG, sulfites) may also occur. This information is for educational purposes only and is not medical advice. Consult your healthcare provider for guidance.
10. RETURNS AND BOTTLE DEPOSITS
- Returns: We sell perishable products, therefore, returns are not accepted. Exceptions apply.
- Bottle Returns: Refunds are provided for eligible glass bottles with receipt. Program rules may change at our discretion.
11. DISCLAIMER OF WARRANTIES
Services, products, and content are provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee accuracy, reliability, or uninterrupted access.
12. LIMITATION OF LIABILITY
In no event will Gooseberry Goods INC or affiliated parties be liable for direct, indirect, incidental, consequential, or punitive damages arising from your use of our Services. Total liability is limited to fees actually paid in the prior twelve months, or the balance of your gift card, whichever applies.

You agree to indemnify and hold harmless Gooseberry Goods INC, its affiliates, and representatives from any claims, damages, or fees arising from your violation of these Terms or use of our Services.
